Terms of Service

Thanks for using our products and services (“Service”). The Service is provided by Ticketmatic (“Ticketmatic”), located at Philipssite 5A bus 22, 3001 Heverlee, Belgium.

By using our Service, you are agreeing to these terms. Please read them carefully. Violation of any of the terms shall result in the termination of your account.

Account terms

Ticketmatic may communicate with you via email regarding your account, updates, news, and other issues related to your account. You automatically get subscribed to our mailing lists but you can opt out from receiving emails.

You are responsible for maintaining the security of your account and password. Ticketmatic cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

You are responsible for all content posted and activity that occurs under your account (even if the content is user generated).

Should we believe that you are abusing the service, we may temporarily suspend your account and will seek your cooperation in this regard.

We reserve the rights to accept or refuse to any potential client. We have the sole discretion on whether to allow you to use the Service.

Ticketmatic or its suppliers own the intellectual property rights to any and all protectable components of the Service, including but not limited to the name of the Service, artwork and end-user interface elements contained within the Service, many of the individual features, and the related documentation. You may not copy, modify, adapt, reproduce, distribute, reverse engineer, decompile, or disassemble any aspect of the Service which Ticketmatic or its suppliers own.

General Conditions

Your use of the Service, including any content, information, or functionality contained within it, is provided “as is” and “as available” with no representations or warranties of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You assume total responsibility and risk for your use of this Service.

To be able to use the Service, you will need to have a Ticketmatic license.

Your account is subject to account limits which can be consulted under “Account & billing”.

The tickets sold through your Ticketmatic account are restricted to tickets sold in your own name and for your own account, or to tickets for events which take place in your premises.

We are constantly changing and improving our Services. Ticketmatic reserves the right to modify and discontinue, at any time and from time to time, temporarily or permanently, the Service (or any part thereof, including pricing) with or without notice.

Ticketmatic shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

All new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Your continued use of the Service after the amended Terms of Service are posted to Ticketmatic’s website constitutes your agreement to, and acceptance of, the amended Terms of Service. If you do not agree to any changes to the Terms of Service, do not continue to use the Service.

You may not use the Service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You understand that the Service can be used for transmission of your Content, and that during processing, your Content may be transferred unencrypted over the internet.

You understand that Ticketmatic uses third party vendors and hosting partners to provide necessary hardware, software, information, networking, storage, and related technology to run the service.

You agree not to resell, duplicate, reproduce, or exploit any part of the Service without the explicit written permission of Ticketmatic.

You may not use the service to transmit any viruses, worms, or malicious content.

Ticketmatic makes no warranties regarding (i) your ability to use the Service, (ii) your satisfaction with the Service, (iii) that the Service will be available at all times, uninterrupted, and error-free (iv), the accuracy of mathematical calculations performed by the Service, and (v) that bugs or errors in the Service will be corrected.

If any provision of the Terms of Service is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby.

Ticketmatic may, but has no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

Data Ownership

We do not claim any intellectual property rights over the material you provide to the Service. All material you upload remains yours. You are responsible for compliance of content with any applicable laws or regulations.

We collect buyers name, email, shipping and billing address, payment details, company name, phone number, IP address and device data. We use this information solely to provide the Service, including supporting and processing orders, authentication, and processing payments. We do not claim any rights over this Personal Information. You agree to post a privacy policy on your website that complies with the laws applicable to your business. You also agree to obtain consent from your customers for the use and access of their Personal Information.

When you upload, submit, store, send or receive content to or through the Service, you give Ticketmatic the right to use this content for the limited purpose of operating, promoting, and improving the Service, and to develop new services. This right continues even if you stop using the Service.

Your data is always available to you: on simple request you will get a backup of your data in a structured format.

Limitation of Liability

You expressly understand and agree that Ticketmatic shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the Service.

In no event shall Ticketmatic or our suppliers be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our Services or these Terms of Service (however arising including negligence). You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, Ticketmatic partners, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis without any warranty or condition, express, implied or statutory.

Ticketmatic does not warrant that the Service will be uninterrupted, timely, secure, or error-free.

Ticketmatic does not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

Ticketmatic does not warrant that the quality of any products, Services, information, or other material purchased or obtained by you through the Service will meet your expectations, or that any errors in the Service will be corrected.

Your sole remedy for dissatisfaction with the Service is to stop using the Service.

About these terms

We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post modifications to these terms on this page. Changes will not apply retroactively and will become effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of the Service.

These terms control the relationship between Ticketmatic and you. They do not create any third party beneficiary rights.

The Terms of Service sets forth the entire understanding between you and Ticketmatic as to the Service, and supersedes any prior agreements between you and Ticketmatic (including, but not limited to, prior versions of the Terms of Service).

If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).

If it turns out that a particular term is not enforceable, this will not affect any other terms.

The laws of Belgium will apply to any disputes arising out of or relating to these terms or the Services. All claims arising out of or relating to these terms or the Services will be litigated exclusively in the courts of Leuven, Belgium, and you and Ticketmatic consent to personal jurisdiction in those courts.
